Terms of Service
Effective Date: April 6, 2026
By using Mio ("we," "us," "our") — including the app, website at mio.gg, and all related services — you agree to these Terms. If you don't agree, don't use Mio.
Who Can Use Mio
You must be at least 18 years old. By creating an account, you confirm you meet this requirement.
What Mio Does
Mio is an AI phone assistant. You text it what you need, and it makes or answers phone calls on your behalf using an AI voice agent. After each call, you get a transcript and summary.
Mio is not a human. It uses AI to conduct conversations and may make mistakes, mishear things, or fail to accomplish what you asked. You should always review call summaries and verify important details yourself.
Mio is not a substitute for professional legal, medical, or financial advice.
Your Account
You sign in with your phone number via SMS verification. You're responsible for your account and everything that happens under it. Don't share access with others.
Things You Can't Do
You agree not to use Mio to:
- Break any law or regulation
- Harass, threaten, or impersonate anyone
- Conduct telemarketing, robocalling, or spam
- Commit fraud or deceive call recipients
- Call emergency services (911)
- Violate the Telephone Consumer Protection Act (TCPA) or similar laws
- Interfere with or abuse the Service
We can suspend or terminate your account at any time if you violate these Terms.
Billing
Mio uses a prepaid balance in US dollars. New accounts receive a one-time $5.00 signup credit. This credit is granted once per phone number and cannot be obtained again by deleting and re-creating your account. You can add funds anytime (minimum $5.00) via credit or debit card through Stripe. Each call is charged based on actual infrastructure costs plus a service markup, deducted from your balance after the call.
Balances are non-refundable and don't expire. You can't make calls with a zero balance.
We may change pricing at any time. Changes apply to future calls only and won't affect your existing balance.
Calls and Consent
When Mio makes a call, the AI identifies itself as your assistant. You acknowledge that:
- Call recipients may not want to speak with an AI
- Some jurisdictions require all parties to consent to call monitoring
- You're responsible for knowing and following the laws that apply to your calls
Mio does not record call audio. Calls are processed in real time. After a call ends, only a text transcript and summary are stored — no audio files exist.
Text Messaging
By texting Mio's phone number, you consent to receive SMS messages from Mio in response to your requests. Mio only sends messages in direct reply to user-initiated conversations — no marketing, no promotional messages, no unsolicited texts.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
Your Responsibility
You are responsible for the actions Mio takes on your behalf. If Mio schedules an appointment, makes a commitment, or shares information during a call, that's on you. Review your call results.
Intellectual Property
Mio's code, design, branding, and AI systems belong to us. Your messages, memory, and personal content belong to you. By using Mio, you give us a limited license to process your content to provide the Service.
Third-Party Services
Mio relies on third-party providers for telephony, voice AI, chat AI, and payments. We're not responsible for their availability or performance.
Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DON'T GUARANTEE THAT MIO WILL ALWAYS WORK, THAT CALLS WILL CONNECT, THAT THE AI WILL BE ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIO AI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU'VE PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50, WHICHEVER IS GREATER.
Indemnification
You agree to defend and hold us harmless from any claims, damages, or expenses arising from your use of Mio, your violation of these Terms, or calls made on your behalf.
Disputes
These Terms are governed by the laws of Wyoming. Before any formal action, you agree to contact us at [email protected] and try to resolve things informally for at least 30 days.
If that doesn't work, disputes will be resolved by binding arbitration under AAA rules. You waive any right to participate in a class action.
Termination
You can stop using Mio anytime. We can suspend or close your account at any time, with or without notice. If terminated for violating these Terms, your remaining balance may be forfeited.
Changes
We may update these Terms. Material changes will be communicated through the Service. Continued use after changes means you accept them.
